Acceptable Usage
Agreement and Terms of Service
Content:
All services provided by EIRSITE may be used for lawful purposes
only. Transmission, storage, or presentation of any information,
data or material in violation of any Irish or European Law,
United States Federal, State or City law is prohibited. this
includes, but is not limited to: copyrighted material, material
that is threatening or obscene, material that is "adult
only" content, or material protected by trade secrets and
other statue. The subscriber agrees to indemnify and hold
harmless EIRSITE from any claims resulting from the use of the
service which damages the subscriber or any other party.
Note: Pornography and sex-related merchandising are prohibited
on any server. This includes sexual content, or direct links to
adult content elsewhere. This is also true for sites that
promote any illegal activity or content that may be damaging to
our servers or any other server on the internet. Links to such
materials are also prohibited. EIRSITE will be the sole arbiter
as to what constitutes a violation of this provision.
Examples of non-acceptable content or links
Pirated software

Hackers programs or archives, Warez Sites, Porn,
Spamming Software, Sites without English (this is because
content of site cannot be verified) Sites may be given
special permission, simply email the webmaster first.
EIRSITE will be the sole arbiter as to what
constitutes a violation of this provision.
Traffic Guidelines
Due to the unique resource characteristics and traffic patterns
associated with certain types of sites, the following are
limited to 1 to 10 gigs* (on average, close to a 10,000 -
150,000 hits* per month) of free traffic/bandwidth per month [ *
- depending which hosting plan you are on]:

Sub hosting - any domain housing additional
users, Shareware, sound, video, image and
multimedia archives, Mirror sites, Distribution points, Any site whose primary purpose is file
distribution, All sites with files other than plain text
webpages
Accounts that go over the
allowed free traffic will be charged €10 per gig. Sites must
pre-pay this fee, and site is subject to suspension if bandwidth
is unpaid for.
Additional Terms:

You MUST maintain a separate current copy of
all data stored on eirsite.com servers on your own computer.
The client is responsible for keeping a complete and current
copy of their web site files as backup on a remote system
(not on eirsite.com Web Hosting servers).

You MUST retrieve your E-Mail from our
servers within 7 days and keep your e-mail accounts clean.
Any E-Mail Accounts containing e-mail that is stored on our
servers for more than 7 days may be deleted without notice.
Any E-Mail Account found to contain a virus will be deleted
without notice.

You MUST use the service only for lawful
purposes.

You MUST comply at all times with our
policies. In agreeing, you understand that the policies can
and will change periodically without notice. A complete and

You MUST NOT use or install any type of
script that does any of the following: Enable Chat, Enable
Telnet Access, Redirect visitors to different parts of your
site based upon the domain name (better known as redirection
scripts, intended to enable users to give people their own
domain names by detecting the domain name they are typing
in, and then redirecting them into another section of the
site... usually a directory), spamming, smurfing, sniffing,
hacking, or any other illegal act.

You MUST download to your home computer and
keep any necessary backup of all raw access logs each month.
In order to conserver webspace, any and all access log files
from the previous month will be deleted on the first of each
month.
Background Running Programs:
As a general rule we do not allow background running programs.
We may allow programs to run continually in the background ,
these are considered on a one to one basis and an extra charge
will be incurred based on system resources used and operational
maintenance needed.
IRC:
We do not allow you to link to or use IRC or IRC bots
such as eggdrop, and BitchX on our servers.
Spam Or Unsolicited E-Mail:
Our servers may not be the source, intermediary, or destination
address involved in the transmission of spam, flames, or mail
bombs. Your domain may not be referenced as originator,
intermediary, or reply-to address in any of the above. SPAMMING
sites on other servers which in turn contain links to a domain
on our servers is prohibited. We consider spam any mass
unsolicited message in the mediums of Bulletin Boards,
Newsgroups, Email and any other online medium. In other words,
do not email someone if they do not know you. Also, you are not
allowed to sell or promote spam or spam related products on your
site. If you are found to have spammed, then we will
immediately, without warning, disable your domain.
We reserve the right to refuse or cancel service to known
spammers. Lastly, we reserve the right to determine what
violates this policy. EIRSITE will be the sole arbiter as to
what constitutes a violation of this provision.
As such, any violation will result in immediate deactivation of
services without refund.
Abuse:
Any attempts to undermine, slander, libel,
threaten, or cause harm to a EIRSITE server, customer, employee,
or the company directly is strictly prohibited and is grounds
for immediate termination without refund. In addition, we will
pursue all attempts to the fullest extent of the law.
Indemnification:
Customer agrees that it shall defend, indemnify,
save and hold EIRSITE harmless from any and all demands,
liabilities, losses, costs and claims, including reasonable
attorney's fees asserted against EIRSITE, its agents, its
customers, officers and employees, that may arise or result from
any service provided or performed or agreed to be performed or
any product sold by customer, it's agents, employees or assigns.
Customer agrees to defend, indemnify and hold harmless EIRSITE
against liabilities arising out of;

Any injury to person or property caused by
any products sold or otherwise distributed in connection
with EIRSITE server;

Any material supplied by customer infringing
or allegedly infringing on the proprietary rights of a third
party and
-
Copyright infringement. Customer agrees to
limit the liability of EIRSITE to the amount paid for
service.
Free Software Scripts
EIRSITE is not responsible for any aspect of third party
scripts/themes or add-on software supplied free with EIRSITE
Hosting packages. We do not provide support for same. All
trademarks are owned by their respective companies.
Payments and Fees:
Payment is due on the defined annual recurring billing date of
each year. Cheques that are declined for any reason are subject
to a €20 declination fee. Service will be interrupted on
accounts that reach 90 days past due. Service interrupted for
non-payment will be terminated.
Delinquent Accounts:
EIRSITE may temporarily deny service or terminate this Agreement
upon failure of Customer to pay charges when due. Such
termination or denial will not relieve Customer of
responsibility for the payment of all accrued service fees, or
any collection fees.
Account Cancellation, Refunds and Disputes:
All requests for canceling any service /
services must be made in writing to EIRSITE giving 30 days
notice of cancellation. Confirmation receipt of cancellation
will be sent within 24 hours.
EIRSITE reserves the right to cancel the
service at any time. In this event customers will be entitled to
a pro rata refund based upon the remaining period of service. If
a customer contravenes EIRSITE's terms of service a refund will
not be issued in the event of a cancellation. Customers may
cancel their account at any time. Any incentives offered to
customers when opening the account will also be cancelled.
Customers may be given the option to purchase services which
were offered as start-up incentives in the result of a
cancellation. Keeping

unless the service is cancelled by EIRSITE. In addition some
accounts incur set-up fees, these charges are also
non-refundable.
All billing
disputes must be reported within 30 days of the time the dispute
occurred.

Disclaimer
EIRSITE will not be responsible for any damages your business
may suffer. EIRSITE makes no warranties of any kind, expressed
or implied for services we provide. EIRSITE disclaims any
warranty or merchantability or fitness for a particular purpose.
This includes loss of data resulting from delays, and any and
all service interruptions caused by EIRSITE and its employees.
EIRSITE reserves the right to change or update policies without
notice.
If any terms or conditions are failed to be
followed it will result in grounds for immediate account
deactivation.
Content Management Software
Customers using EIRSITE CONTENT MANAGER or Web Page Publisher
software are bound by the Terms of the Software License
Agreement which can be seen at this address;-
